Cape town: The Judicial Matters Amendment Bill aims to address legal uncertainties and improve justice administration across multiple areas, Deputy Minister of Justice and Constitutional Development, Andries Nel, stated during a briefing to Parliament's Portfolio Committee on Justice and Constitutional Development.
According to South African Government News Agency, Deputy Minister Nel emphasized that the Bill amends various statutes managed by the Department, tackling practical implementation challenges, responding to Constitutional Court judgments, and improving justice administration. He noted that South Africa's constitutional democracy has shown significant resilience, with institutions maturing and courts developing a robust body of constitutional jurisprudence. Parliament has been refining the legislative framework to ensure responsiveness to constitutional developments.
The Deputy Minister explained that the purpose of the Judicial Matters Amendment Bill is to ensure that justice legislation remains current, coherent, and constitutionally compliant, supporting an effective justice system. The Bill highlights the necessity of continuous maintenance, careful refinement, and responsible legislative stewardship to uphold the rule of law.
The Bill aims to build a more effective, accessible, and accountable justice system. It strengthens judicial accountability by amending the Judicial Service Commission Act, enabling additional judges to address backlogs and ensure efficient handling of disciplinary matters. The Bill also enhances openness and transparency through amendments to the Promotion of Access to Information Act, improving access to information and aligning with Constitutional Court judgments.
Additionally, the Bill addresses corruption by closing gaps in the Prevention and Combating of Corrupt Activities Act, ensuring appropriate penalties for failing to prevent corruption within entities. It supports reforms from the State Capture Commission's recommendations, reinforcing South Africa's anti-corruption efforts.
Furthermore, the Bill promotes a humane and developmental child justice system by aligning cannabis-related offences involving children with child-centred interventions. It also seeks to modernize the legal profession through proposed amendments to the Legal Practice Act, improving access to legal services and supporting transformation within the profession.
The Bill addresses cybercrime by clarifying investigative powers and improving the legal framework for cybercrime investigations. The Department of Justice and Constitutional Development has carefully considered stakeholder submissions, recommending amendments where proposals have strengthened the Bill.
