Pretoria: The Department of Transport has announced a delay in the implementation of the Administrative Adjudication of Road Traffic Offences (AARTO) Act, pushing the start date to 1 July 2026. This postponement comes after an assessment of readiness in the municipalities targeted for the first phase of the rollout.

According to South African Government News Agency, the assessment identified several areas needing further attention before AARTO can be effectively implemented. Key issues include the completion of training for law enforcement officers and back-office personnel, harmonising existing municipal law enforcement systems, and securing necessary funding to align with AARTO’s requirements.

The department plans to release a new proclamation outlining staggered implementation dates, maintaining the phased approach originally planned. The AARTO Act aims to create safer roads through a uniform traffic law enforcement system and introduce a demerit points system for traffic offenders.

Under this system, individuals and operators incur penalties and demerit points for traffic infringements, with points assigned based on the severity of the violation. The demerit system targets operators rather than vehicles, holding them accountable for vehicle use, and all will start with zero points upon implementation.

Western Cape MEC for Mobility Isaac Sileku supported the delay, citing it as an opportunity to prepare municipalities, enforcement agencies, and operational teams for the transition. Sileku emphasized the importance of addressing training gaps, system harmonisation, and funding to ensure an efficient nationwide rollout.

Sileku stated that this deferment allows for proper implementation, urging all government spheres and stakeholders to collaborate for a successful transition. The Western Cape Government reaffirmed its commitment to working with national and local partners to ensure alignment and readiness as the new phased timelines progress.
