Tshwane: President Cyril Ramaphosa has announced that he will not resign in light of the recent Constitutional Court judgment regarding the Section 89 impeachment process related to the 2020 theft at his Phala Phala farm. The President addressed the nation from the Union Buildings, asserting that the court's ruling does not obligate him to step down, and doing so would undermine efforts to renew the country's institutions and uphold constitutional processes.
According to South African Government News Agency, the Constitutional Court ruled that certain National Assembly rules for removing a President are inconsistent with the Constitution. This ruling stems from a report by an independent panel, appointed by the National Assembly in September 2022, to investigate the allegations concerning the theft at the President's farm. The panel suggested that there was prima facie evidence of serious misconduct by President Ramaphosa, but the National Assembly voted against referring the report to an impeachment committee in December 2022. The court has now ordered the report to be sent to the Impeachment Committee.
President Ramaphosa has expressed his acceptance of the judgment and reiterated his commitment to the Constitution, the judiciary's independence, and the rule of law. He announced plans to seek a judicial review of the panel's report, claiming it contains significant flaws. He emphasized that his decision is not out of disrespect for parliamentary processes but to ensure legal accuracy in the findings that inform Parliament's actions.
The President strongly denied any wrongdoing, maintaining that he has cooperated with all investigations and has not violated his oath of office. He pointed out that the Constitutional Court made no findings regarding his conduct or any prima facie evidence of misconduct. He emphasized that resigning now would hinder efforts to rebuild institutions, combat corruption, and advance economic recovery.
