Pretoria:The Special Investigating Unit (SIU) has executed a search and seizure operation at the Private Security Industry Regulatory Authority (PSIRA) offices in Centurion, Pretoria. This operation was carried out in collaboration with the Directorate for Priority Crime Investigation, known as the Hawks.
According to South African Government News Agency, the SIU was authorized in June by a proclamation from President Cyril Ramaphosa to investigate allegations of maladministration and unlawful conduct associated with a R130 million training contract awarded by PSIRA. The SIU had initially requested documentation related to the contract from PSIRA.
The documentation provided was incomplete, omitting a year's worth of necessary documents. As a result, the SIU sought a search warrant from the Special Tribunal to obtain documents and electronic devices, such as cell phones and computers, to further their ongoing investigation.
The SIU explained that search and seizure operations are used as a last resort when full cooperation through cordial engagement is not achieved. Under the Special Investigating Units and Special Tribunals Act 74 of 1996, the SIU has the authority to subpoena bank statements and cellphone records, search and seize evidence, and interrogate witnesses under oath.
The SIU also noted its power to initiate civil action in the High Court or a Special Tribunal to address any wrongdoing uncovered during investigations involving corruption, fraud, or maladministration. Evidence indicating criminal conduct will be referred to the National Prosecuting Authority for further action.
