Pretoria: The monetary jurisdiction of Small Claims Courts across South Africa will increase from R20,000 to R30,000, effective from August 1, 2026, in an effort to enhance access to justice. This adjustment, the first in seven years, aims to ensure that legal recourse is determined by the merits of a dispute rather than a citizen's financial status. Small Claims Courts provide a straightforward, affordable, and efficient platform for resolving civil disputes without the need for legal representation.
According to South African Government News Agency, Deputy Minister of Justice and Constitutional Development Andries Nel emphasized that this practical reform reinforces the government's constitutional commitment to equality before the law. By raising the monetary jurisdiction to R30,000, the government is enabling more South Africans to enforce their rights without resorting to expensive and time-consuming litigation. This measure is part of a broader initiative to build a justice system that is accessible, affordable, efficient, and responsive to the needs of all citizens.
Nel noted the significance of this move as South Africa marks the 30th anniversary of its Constitution, highlighting that access to justice is a cornerstone of the country's constitutional democracy. Small Claims Courts ensure that justice is not only affordable but also uncomplicated and effective, allowing ordinary people to resolve everyday disputes fairly and promptly. By expanding access to these courts, the government continues to translate the constitutional promise of equal protection and benefit of the law into a reality for all, regardless of their financial means.
According to the Justice department, the impact of South Africa's 418 small claims courts is considerable. In the past financial year, approximately 36,000 cases with a total value of R257 million were registered. In the first quarter of the current financial year alone, 8,825 cases have been registered, amounting to claims worth R64 million. The courts handle a wide range of civil matters, including unpaid loans, personal debt recovery, consumer claims related to faulty products or incomplete services, vehicle-related disputes, and credit agreement issues.
Citizens wishing to file a claim can seek assistance from the Clerk of the nearest Small Claims Court, located at a Magistrates' Court, to complete and serve the necessary documentation. Small Claims Court matters are overseen by Commissioners appointed by the Deputy Minister of Justice and Constitutional Development. These Commissioners, who include practicing attorneys, advocates, legal academics, Legal Aid South Africa attorneys, and magistrates, provide their services pro bono in the public interest. The department has also indicated that further incremental increases in monetary jurisdiction will be considered in the near future.
